KAYAK WAIVER

THIS IS A WAIVER AND RELEASE OF LIABILITY - YOU MUST READ AND FULLY UNDERSTAND THIS BEFORE SIGNING - IF YOU ARE UNDER THE AGE OF 18, YOUR PARENT OR LEGAL GUARDIAN MUST SIGN THIS.

I AM AWARE THAT THE DESCRIBED ACTIVITIES FROM CRYSTAL CLEAR KAYAK TOURS ANTIGUA ARE HAZARDOUS ACTIVITIES, AND I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE.

I hereby agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of CRYSTAL CLEAR KAYAK TOURS ANTIGUA or any of their affiliated organizations for injury or damage resulting from the negligence or other acts, however caused, by any director, employee, agent, or contractor of CRYSTAL CLEAR KAYAK TOURS ANTIGUA or any of their affiliated organizations as a result of my participation in the activities described above. I forever release CRYSTAL CLEAR KAYAK TOURS ANTIGUA, and any of their affiliated organizations from any and all action, claims, or demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have or may hereafter have for injury or damage resulting from my participation in the activities described above.

You agree that you are responsible for yourself and the while in your possession for any accidents or incidents that may arise due to your negligence or any other instance where you are found to be at fault. CRYSTAL CLEAR KAYAK TOURS ANTIGUA will not be held responsible whatsoever. You will be required to replace any lost or broken equipment that may be provided for your use during the tour such as kayak parts. You agree that before and upon return from the tour that all equipment given to you will be checked for condition and will be charged to you in such a case where loss or damage to CRYSTAL CLEAR KAYAK TOURS ANTIGUA property is found.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND CRYSTAL CLEAR KAYAK TOURS ANTIGUA AND/OR THEIR AFFILIATED ORGANIZATION, AND SIGN IT OF MY OWN FREE WILL.

Photo Release
I, hereby grant and authorize CRYSTAL CLEAR KAYAK TOURS ANTIGUA the right to edit, alter, copy, any and make use of all photos and or videos taken of me to be used in and/or for promotional materials without payment on consideration. The grant of use includes but is not limited to publishing on Internet and e-mails, magazines, pamphlets, advertisement fliers, and in whatever other manner the photographer finds useful or for any other lawful purpose.

I understand and agree that the materials / photos will become CRYSTAL CLEAR KAYAK TOURS ANTIGUA property and will not be returned. This release extends to all formats, media, languages and formats now known or hereafter developed. This Release shall continue indefinitely, unless I otherwise revoke said Release in writing.
In addition, I waive any right to royalties or other compensation arising or related to the use of the photos. I hereby release rights to all claims, demands, and causes to action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf of my estate have or may have by reason of this.
